General Terms and Conditions (GTC) for purchases made on ciaccini.com

Throughout the site, the terms “we”, “us” and “our” refer to Piero Modena Entreprise Individuelle. Piero Modena Entreprise Individuelle offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
SECTION 1- SCOPE OF THE GENERAL TERM AND CONDITIONS OF SALES
By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. Please read these GTC carefully before accessing or using our website.
These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
SECTION 2- PRODUCTS
The products offered are those listed on the website www.ciaccini.com, within the limits of available stocks.If, in spite of our vigilance, the products prove to be temporarily or definitively unavailable, we will inform you by e-mail as soon as possible. In the event of definitive product unavailability after placing your order, we will offer you either a refund or the exchange of the product in shortage of stock by a similar product by its price and its characteristics.
We reserve the right to modify the assortment of products at any time.
Each product is presented on the website in the form of a description containing its main characteristics and with images. We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your electronic display will accurately reflect the actual colors and details of the products.
SECTION 3- PRICESThe prices of the products are indicated on the website in Swiss francs (CHF), and include VAT.
We reserve the right to modify its prices at any time, it being understood, however, that the price appearing in the web catalogue on the day of the order will be the only one applicable to the buyer.
The prices indicated do not include delivery costs, invoiced in addition to the price of the products purchased according to the total amount of the order.
For shipments outside Switzerland, any customs fees and other taxes must be paid by the customer directly to the carrier.
SECTION 4- PURCHASE AND PAYMENT METHODS
As a payment method, we accept Credit Card and Paypal. Any costs associated with the transaction are your responsibility.
We reserve the right to refuse any order placed through our site. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders places by or under the same customer account, the same payment method, and /or the use the same billing address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.
SECTION 5- DELIVERY
Deliveries are made to the address indicated on the order form which can only be in the agreed geographical area. Orders will leave our warehouse within 48 hours excluding weekends and holidays.
Delivery times are only indicative; If these exceed thirty days from the order, the sales contract may be terminated, and the buyer refunded. We will be able to provide the buyer by e-mail with the tracking number of his package on request to hello@ciaccini.com.
The transport related risks are the responsibility of the purchaser from the moment the items leave our warehouse. The buyer is required to check in the presence of the employee of La Poste or the deliverer, the condition of the packaging of the goods and its contents on delivery. In the event of damage during transport, any complaint must be made to the carrier within three days of delivery.
Any order placed on the site for delivery outside Switzerland may be subject to possible taxes and customs duties in the country of destination. These customs duties and any taxes are the responsibility of the buyer and are his responsibility.
We cannot be held responsible for any delay and/or costs related to the customs clearance of products, and thus disclaims any legal liability if taxes were not paid by the buyer.
SECTION 6- RIGHT OF RETURN AND REFUNDS The buyer has the right to return the goods within 14 working days from the delivery of the order.In the hypothesis of the exercise of the right of return, the consumer has the choice to ask either for the refunding of the products, or an exchange for an equivalent amount. Goods must be returned in the same condition in which you received them, unworn and in their original packaging. We reserve the right not to accept any damaged or soiled merchandise and will return it to the sender.
- RETURN FOR REFUND: Once we receive the goods, we will proceed with the refund in 1-2 business days, except for the return costs which remain the responsibility of the consumer, only if the return conditions are respected. For payments made through PayPal or Credit Card, the refund will be made to the same PayPal or Credit Card account.
- RETURN FOR EXCHANGE: If you want to exchange size or color, send us back the original purchase within 14 days. Once we will receive it, we will send you the new size/color. Shipping cost for the returns remains a customer’s responsibility, however in this case we will cover the new shipping for exchange.
Any return or exchange must be reported in advance by email to hello@ciaccini.com stating your order number.
We are not responsible for any lost returns. We recommend a shipping method with proof of delivery or tracking number.
SECTION 7 – CORRECTIONS
There may be information on our site that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors , inaccuracies or omissions and to change or update the information on the site at any time, without prior notice. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.
SECTION 8- WARRANTY
The guarantee applies for defects and discrepancies established by law. If defects and discrepancies are found in the product purchased, we expressly reserve the right to supply the purchaser with another product free of defects (except for one-off products that will be replaced with a similar product).

These general conditions are subject to Swiss law, which regulates the aspects not expressly mentioned by these general conditions. The international sales agreement (CISG) and any other inter-state agreements are not applicable.
